1. Introduction 

1.1. These Terms and Conditions (Terms of Service) govern your relationship with DTCSIWEB3 Academy Limited (the academy). By accepting this Terms of Service, you agree to be bound by it. If you disagree with this Terms of Service or any part of it, the services offered by the Academy may not be available to you unless you enter into a separate written agreement with the Academy in this regard. Please ensure that you read and fully understand all the terms and conditions stated herein before signing the same.

1.2. The Academy reserves the right to revise, at its discretion, and at any time it deems fit, the terms and conditions contained herein. Such revision(s) may be in the form of an amendment, substitution of paragraphs or addition of further terms and/or conditions to this Terms of Service. By accepting this agreement, you agree to continually be bound by any such revision. 

1.3. The Academy is designed to provide training for the acquisition of skills and knowledge in the courses offered by the Academy. The Academy offers a wide array of courses, each designed to meet the evolving demands of the digital economy. These courses are outlined and briefly described below.
– Graphics Design: Unlocking creativity and visual communication skills.
– Blockchain Development: Building the future of decentralised digital transactions.
– Forex Trading: Mastering currency markets for financial success.
– Airdrop Hunting: Navigating the world of cryptocurrency incentives.
– Web3 Architecture: Pioneering the next generation of internet services.
– Social Networking: Leveraging connections for growth and opportunity.
– DeFi (Decentralized Finance): Revolutionizing finance through secure and open systems.

2.0. Definitions and Interpretation

In this Terms of Service, the following terms shall have the following meanings:
“Services“: means the courses offered by the Academy and which are available to customers.
“Premises“: Means our place of business, located at Prince and Princesses, Ishieke, Ebonyi Local Government Area, Ebonyi State.
“Customer“: means a trainee or intending trainee of the Academy.

3.0. Payments and fees

3.1. The Academy charges a stipulated fee for training of customers in any of the courses/services offered by the Academy. By signing this Terms of Service, the customer agrees with the fees stipulated by the academy for any, or an array of selected course(s), as well as any revision to the said fees.

3.2. The Academy reserves the right to revise the fees chargeable for any or a selection of its services, insofar as the customer is duly informed of such a revision of fees by notice, oral or written. A revision in the price of the Academy’s courses/services may not apply to services already paid for by the customer or which have been fully rendered by the Academy. However, by the continued usage of the services, the customer confirms acceptance of such revised fees.

4. Data Privacy

4.1. The academy strongly respects your right to privacy. Any information obtained from you in the course of signing this Terms of Service, filling forms that may be required by the Academy or in furtherance of your training, shall be dealt with in compliance with the Data Protection Act, 2023.

4.2. Further, we may use your personal information to:
• Provide our services to you;
• Process your payment for the services; and
• Inform you of new products and services available from us. (You may request that we stop sending you this information at any time.)

5. Disclaimers

5.1. We make no warranty or representation that the skills and knowledge obtained from any of our courses/services would guarantee automatic enrichment or inflow of pecuniary rewards. While these courses/services are invaluable in the digital, financial and online market, we do not represent that our services will meet your requirements, that they will be of your desirable quality or that they will be fit for a particular purpose for which you intend to utilise it.

5.2 Adjunct to the above, we make no guarantee of any specific results from the skills and knowledge acquired from our course(s)/services.

5.3. Please note that the courses offered by the Academy are not to be used or intended to be used for fraudulent, unlawful or criminal activities/endeavours.

6. Conduct

6.1. The following conducts are considered objectionable by the Academy:
• Disrespect: Like every modern institution, the Academy does not condone harmful gestures or verbal or written comments intended to insult, harass or intimidate others.
• Drug Violation: The use of illegal substances and psychoactive drugs are highly prohibited within the Academy.
• Physical Attacks: This would include fighting, gang activities and any activity that would cause mild or serious bodily harm.
• Sexual Activities: Behaviors of a sexual nature such as public display of affection, consensual activities, possession of pornographic materials and sex-related crimes, such as rape.
• Alcohol: Drinking of alcohol within the premises of the Academy.
• Fraud: Fraudulent activities in whatever guise or manner (internet-related or not).
• Criminal Activities: The commission of any crime whatsoever.  

6.2. The Academy reserves the right to discontinue its services to a customer who engages, aids or assists any of the aforementioned activities.

6.3. Where the Academy discontinues its services as stated in (6.2) above, the affected customer shall not be entitled to a refund of fees already paid.

7. Refund policy

7.1. The Academy operates a no-refund policy in its dealings with customers. The customer is not entitled, either in part or in full, to a refund of any fees duly paid for the services of the Academy. Where a customer, while indebted to the Academy, unilaterally withdraws from the Academy or if the Academy discontinues its services to a customer, such debt shall immediately become due and payable to the Academy before the expiration of 7 (seven) days from the date of such withdrawal or discontinuance.

7.2. To exercise the right of withdrawal, you must inform the Academy of your decision to withdraw from this Terms of Service in writing, unequivocally. If you have any issues with the Academy’s no-refund policy, please contact the administration of the Academy for clarification before attesting to this Terms of Service.

8. Miscellaneous

8.1. This Terms of Service, in its current form or as may be amended by the Academy at its discretion, constitutes the entire contract between the Academy and the customer. Any promises, representations, offers, or other communications not expressly outlined in this Terms of Service or any other written agreement duly entered by the Academy, are of no force or effect.

8.2. Any waiver by the Academy of any breach of this Terms of Service must be in writing and signed by an authorised officer of the Academy. The waiver by the Academy of any breach of this Terms of Service by a customer shall not operate or be construed as a waiver of any subsequent breach.

8.3. You agree that as a customer of the Academy, you are not an employee, partner or agent of the Academy. 

8.4. A decision by the Academy not to exercise or enforce any right or provision of this Terms of Service does not constitute a waiver of such right or provision.
